Terms of Service

These Terms of Service govern your use of heart717.com and any purchase made through it. By accessing the site or placing an order, you agree to these terms. The site is operated by HEART 717 LLC, 800 West Ave, Miami Beach, FL 33139, United States — EIN 39-2161513 ("we", "us", "HEART717").

1. The works

Each HEART717 piece is a wearable artwork produced in a limited edition of fifty individually numbered pieces. Once an edition is complete, that work is not reproduced. Product images are representative; slight variations in print placement, tone and finish are inherent to the process and are not defects.

2. Orders

An order constitutes an offer to purchase. The contract is formed when we send you the order confirmation email. We may refuse or cancel an order in case of pricing errors, suspected fraud, unavailability of the piece, or where we are unable to ship to your address. If we cancel a paid order, we refund it in full.

3. Prices and payment

Prices are shown in euro and include applicable taxes where indicated. Shipping is calculated at checkout. We accept the payment methods displayed at checkout. Payment is processed by our payment providers; we do not store your card details.

4. Shipping and risk

Processing and delivery times are set out in our Shipping Policy. Estimated times are indicative and not guaranteed. We are not liable for delays caused by carriers, customs procedures or events beyond our reasonable control.

Risk of loss or damage passes to you only when you, or a third party designated by you other than the carrier, take physical possession of the goods. Until that moment the risk remains with us.

5. Right of withdrawal and returns

If you are a consumer, you have fourteen days from the day you receive the goods to withdraw from the purchase without giving any reason. Full conditions, timings and the treatment of any diminished value are set out in our Refund Policy, which forms part of these terms.

6. Legal guarantee

Consumers benefit from the legal guarantee of conformity provided by applicable law. If a piece is defective or not as described, contact us at support@heart717.com and we will remedy it at no cost to you.

7. Intellectual property

All content on this site — including artworks, images, text, graphics, the HEART717 name and marks — is owned by or licensed to HEART 717 LLC and protected by intellectual property law. Purchasing a piece grants you ownership of that physical item only. It does not transfer any right to reproduce, distribute, resell commercially, or create derivative works from the artwork.

8. Use of the site

You agree not to use the site for any unlawful purpose, not to attempt to gain unauthorised access to it, and not to interfere with its operation or security. We may suspend access in case of misuse.

9. User content

If you send us comments, images or suggestions, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish them in connection with the brand. You confirm that such content is yours and does not infringe the rights of others. We may remove any content at our discretion.

10. Accuracy of information

We take care to keep the site accurate and up to date, but we do not warrant that all content is free from error. We may correct information, prices and availability at any time without prior notice.

11. Third-party links and services

The site may contain links to third-party sites or use third-party services. We are not responsible for their content, policies or practices.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the site. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded under applicable law. These terms do not affect your mandatory statutory rights as a consumer.

13. Indemnity

You agree to hold HEART 717 LLC harmless from claims arising out of your breach of these terms or of applicable law.

14. Privacy

Personal data is processed as described in our Privacy Policy.

15. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment of your order is the one that applies to that order.

16. Governing law and disputes

These terms are governed by the laws applicable at the seller's place of establishment. If you are a consumer resident in the European Union, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of that country.
